Behested Payments and Form 803
Behested payments are payments (donations) made at the behest of an elected official for legislative, governmental or charitable purposes. (Gov. Code § 82015(b)(2)(B)(iii)) Behested payments are not considered gifts, but must be disclosed if donations from a single source in a calendar year equal or exceed $5,000. The Fair Political Practices Commission provides Form 803 to facilitate the reporting of behested payments. Form 803s are kept on file by the Clerk of the Board’s office and the Registrar of Voters. Exception: If the behested payment is made by a state, local, or federal government agency and is principally for legislative or governmental purposes, the payment does not have to be reported.
